Específicamente me centré en reflexionar sobre las Democracias desiguales en América Latina -y, fundamentalmente, en Argentina- en relación a los y las jóvenes en situación de vulneración. El punto de inflexión sobre el que me interesa profundizar es aquel que contrapone, por un lado: el enfoque de derechos que entiende a los jóvenes como “sujetos con derechos” (con las dificultades que esta propuesta presenta), y por otro, la reciente re-inauguración de viejas perspectivas que se vienen dando a partir del avance del neoliberalismo en el continente. Para emprender esta tarea pongo en diálogo conceptos como Democracia, derechos, desigualdad, Estado, políticas públicas, neoliberalismo y jóvenes. La metodología es fundamentalmente cualitativa y el principal método es la exploración de bibliografía específica para elaborar el tema. También recupero algunos análisis trabajados anteriormente en mi Trabajo Final de Grado de la Licenciatura en Sociología (UNVM) sobre jóvenes y políticas públicas.
This work constitutes the closing of the Specialization in Public Policies for Equality that I studied during the year 2017-2018 in CLACSO. Through the same I intend to integrate in a subject of personal interest the different modules studied in the course. Specifically, I focus on the unequal democracies of Latin America and Argentina in relation to young people in a situation of violation. The point of inflection around which I am interested in reflecting is that which opposes on the one hand: the rights approach that understands young people as "subjects with rights" (with the difficulties that this proposal presents), and on the other, the recent - inauguration of old perspectives that have been taking place since the advance of neoliberalism in the continent. To undertake this task I put into dialogue concepts such as Democracy, rights, inequality, State, public policies, neoliberalism and young people. Which way will Egypt go now that Husni Mubarak's authoritarian regime has been swept from power? Will it become an Islamic theocracy similar to Iran? Will it embrace Western-style liberalism and democracy? Egypt after Mubarak reveals that Egypt's secularists and Islamists may yet navigate a middle path that results in a uniquely Islamic form of liberalism and, perhaps, democracy. Bruce Rutherford draws on in-depth interviews with Egyptian judges, lawyers, Islamic activists, politicians, and businesspeople. The events of September 11 and the subsequent war on terrorism have provoked widespread discussion about the possibility of democracy in the Islamic world. Such topics as the meaning of jihad, the role of clerics as authoritative interpreters, and the place of human rights and toleration in Islam have become subjects of urgent public debate around the world. With few exceptions, however, this debate has proceeded in isolation from the vibrant traditions of argument within Islamic theology, philosophy, and law. Islam and the Challenge of Democracy aims to correct this deficiency. The book engages the reader in a rich discourse on the challenges of democracy in contemporary Islam. The collection begins with a lead essay by Khaled Abou El Fadl, who argues that democracy, especially a constitutional democracy that protects basic individual rights, is the form of government best suited to promoting a set of social and political values central to Islam. Because Islam is about submission to God and about each individual's responsibility to serve as His agent on Earth, Abou El Fadl argues, there is no place for the subjugation to human authority demanded by authoritarian regimes. Whether examining election outcomes, the legal status of terrorism suspects, or if (or how) people can be sentenced to death, a judge in a modern democracy assumes a role that raises some of the most contentious political issues of our day. But do judges even have a role beyond deciding the disputes before them under law? What are the criteria for judging the justices who write opinions for the United States Supreme Court or constitutional courts in other democracies? These are the questions that one of the world's foremost judges and legal theorists, Aharon Barak, poses in this book. In fluent prose, Barak sets forth a powerful vision of the role of the judge. He argues that this role comprises two central elements beyond dispute resolution: bridging the gap between the law and society, and protecting the constitution and democracy. The former involves balancing the need to adapt the law to social change against the need for stability; the latter, judges' ultimate accountability, not to public opinion or to politicians, but to the "internal morality" of democracy. Barak's vigorous support of "purposive interpretation" (interpreting legal texts--for example, statutes and constitutions--in light of their purpose) contrasts sharply with the influential "originalism" advocated by U.S. Supreme Court Justice Antonin Scalia. Rights, Action, and Social Responsibility: Public debates surrounding immigration policy, climate change, international relations, and constitutional and human rights are currently at the forefront of our national discourse. Critical reasoning, supported through academic research is needed.
